  • Successful defence of a municipality and health and life insurer of a claim alleging the municipal staff negligently advised and documented a group death benefit nominating a designated beneficiary—settled for zero payment. The life insurer paid 100% of death benefit in accordance with deceased firefighter’s wishes.
     

  • Successful prosecution of a statutory trust (Construction Lien Act) trial—decision routinely cited in jurisdictions in Superior Courts across Canada—solicitor and client costs awarded.
     

  • Successful defence of a multi-party class action against Crown Corporations responsible for inventing technology and having regulatory responsibility over gas-fired appliances, including residential furnaces. Settled for zero payment.

 

  • Successful defence at a trial of energy sector Crown Corporation in case commenced by an individual claiming the right to a survivor pension where a substantial amount of money was claimed and precedent-setting circumstances were at stake. Costs award in excess of $60,000. Decision affirmed (upheld) on appeal.
     

  • Successful injunction on behalf of health and life insurer client against claimant for long-term disability resulting in orders against claimant to preserve and produce business records that effectively ended claimant’s case for disability benefits for zero payment by insurer.

 

  • Successful application for constructive trust [a type of legal remedy] impressed on real estate registered in the name of an apparent purchaser who contributed nothing to the purchase price of the property.
     

  • Successfully negotiated discharge Certificate of Pending Litigation (CPL) registered on title of the family home of Toronto individuals by a major Canadian retail bank.
     

  • Successfully opposed motion to discharge certificate of pending litigation obtained by a retired couple defrauded by a rogue builder.

 

  • Successful application in Commercial List wherein the court set aside the registration of a general security agreement for irregularities by an unconventional angel investor and ordered the deputy registrar of the registration system for registration of security interests under the Personal Property Security Act to be discharged permitting financing by a European Bank.
     

  • Successful fraudulent embezzlement case against Ontario physician settled for full amount of claim  secured by consent judgment expressly surviving bankruptcy.
     

  • Successful employment case for senior members of the community employed as apartment supervisors who disobeyed their employer by taking an 11th day of annual leave and succeeded in their damages claim against large apartment building owner client—solicitor and client costs awarded.
